Practice Nest Studio
Product License & Terms of Purchase
This is the agreement between you, the practice or buyer, and Practice Nest Studio. Please read it before you purchase. By purchasing, downloading, or using a product, you agree to everything below.
1. Acceptance
You accept this agreement when you check the box at checkout confirming you have read and agree to it, or, if no box is shown, when you complete your purchase or use the product. If you do not agree, do not purchase or use the product.
2. What you are buying
You are buying a license to use the product. You are not buying ownership of the product or its underlying design, code, or content. We grant you a non-exclusive, non-transferable license to use the product within one practice for internal practice use. The license covers the providers and staff of that one practice.
3. What you may do
- Use the product inside your own practice, on your own devices.
- Use it with as many of your own patients as you like, within that one practice.
- Print, save, or export the reports the product generates for your own internal use.
4. What you may not do
- Resell, license, sublicense, rent, or give the product to anyone else.
- Share the product, its files, or your purchase link with another practice, location, or owner.
- Post the product or its files publicly, or upload them anywhere others can download them.
- Copy, modify, or adapt the product in order to redistribute it or build a competing product.
- Remove or alter any copyright, license, or branding notice in the product.
Each practice that wants to use a product needs its own license. If you own more than one practice or location, contact us about additional licenses.
5. Ownership and copyright
The product and everything in it, including its design, layout, code, text, charts, and PDF templates, are the property of Practice Nest Studio and are protected by copyright. All rights not expressly granted to you in this agreement stay with us.
6. How the product works and your responsibility for data
Our tools store the information you enter, including any patient information, locally in your own web browser on your own device. Practice Nest Studio does not collect, receive, or store that information and has no access to it.
You and your practice remain solely responsible for how you store, protect, back up, and manage any information you enter, and for complying with any privacy, security, and recordkeeping laws that apply to your practice.
7. Internal use only, not clinical advice
The product is designed for internal practice use. It is not a substitute for your clinical judgment, your clinical documentation, or your electronic health record, and it is not an electronic health record. It does not provide medical advice or direct patient care. You are responsible for all clinical decisions in your practice.
8. Refunds
Because the product is delivered digitally and immediately, all sales are final and we do not offer refunds once the product has been delivered. If something is wrong with your purchase or you cannot access your download, contact us at practiceneststudio@gmail.com and we will make it right.
9. Chargebacks
If you have any problem with your purchase, contact us first at practiceneststudio@gmail.com so we can resolve it. Because the product is a licensed digital good delivered immediately, a change of mind is not a valid basis for a payment dispute. Filing a chargeback without contacting us is a breach of this agreement and ends your license to use the product.
10. No warranties
The product is provided as is and as available. We do not promise that it will be error-free, uninterrupted, or fit for any particular purpose beyond what is described on our site. To the fullest extent allowed by law, we disclaim all warranties not expressly stated here.
11. Limitation of liability
To the fullest extent allowed by law, Practice Nest Studio is not liable for any indirect, incidental, or consequential damages arising from your use of the product. Our total liability for any claim related to a product will not exceed the amount you paid for that product.
12. Updates
We may update or improve a product over time. Your license covers the version you purchased and any updates we choose to make available to you. We are not obligated to provide updates.
13. Ending the license
This license ends automatically if you break any part of this agreement, including the restrictions in Section 4 or the chargeback terms in Section 9. If your license ends, you must stop using the product and delete its files.
14. Governing law
This agreement is governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.
